Now everyone can choose to live anywhere in the world, travel all year round and still work. However, despite the apparent freedom of movement, every person has to face the need to establish a tax residence &#8211; official recognition of the place of residence for tax purposes.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Tax residence determines the country in which a person is liable <a href=\"https:\/\/alegria-service.com\/blog\/business\/taxes-in-spain-for-non-residents-types\/\">pay taxes<\/a>, and, as a result, affects its financial and legal obligations. Understanding exactly how tax residence is established is especially important for those who choose Spain as their new home or place of long-term stay.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In this article we will take a closer look at what a Spanish tax residence is and what nuances need to be taken into account when determining your tax resident status.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Spanish tax residents \u2013 individuals<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">To understand exactly what criteria Spain uses when determining the tax residence of individuals, let us turn to the website of the Spanish Tax Service. The Spanish Tax Authority considers an individual to be a resident for tax purposes if at least one of the following conditions is met:<\/span><\/p>\n<ol>\n<li><b>Stay in Spain for more than 183 days during a calendar year.<\/b><span style=\"font-weight: 400;\"> Spanish legislation establishes that a tax resident is any individual who stays in the country for more than 183 days during one calendar year. When calculating this period, all, even short-term, entries and exits from the country are taken into account, unless the individual confirms that he is a tax resident of another country. In the case of offshore countries and territories, the Spanish tax authorities may require proof of actual stay there for 183 days. The law excludes from the calculation of the period of stay in Spain days spent participating in cultural or humanitarian missions in cooperation with Spanish public institutions, unless such participation involves financial remuneration.<\/span><\/li>\n<li><b>The presence in Spain of a center of economic interests, or a center of activity, or a main source of income. <\/b><span style=\"font-weight: 400;\">Also, a tax resident of Spain is considered to be a person whose main source of income or central economic interests are located directly in this country, and economic ties can be either direct or indirect.<\/span><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">The law also states that an individual is a tax resident of Spain (unless the contrary is proven) if his legal spouse, in respect of whom at least one of the above criteria is met, as well as minor children who are dependent on him, permanently reside in Spain.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">For Spanish citizens intending to confirm that they are tax residents of any offshore, the following rule applies: the obligation to pay personal income tax (IRPF) remains in respect of them both in the year in which the change of tax residence occurred, and for four subsequent years.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">It should also be remembered that a change in tax residence during the year does not interrupt the tax period, which means that the resident or non-resident status remains with the person for the entire calendar year.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Confirmation and termination of tax residence in Spain<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Tax residence is confirmed by a special certificate issued by the competent tax authority of the relevant country. The validity of such a certificate is one year. In Spain, such a certificate can be obtained electronically almost instantly through your personal account on the tax service website.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Please note that having a residence permit or administrative residence in a particular country, including Spain, does not automatically grant you tax resident status. In Spain specifically, the above conditions must be met.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">To cease being a tax resident in Spain or to confirm your tax residence in another country, you must submit a tax residence certificate to the local tax authorities. Refusal of Spanish tax residence assumes that neither the taxpayer himself nor his family will be in the country for more than 183 days a year, nor will they have a center of economic interests here.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Avoidance of double taxation<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Being a tax resident in Spain or a tax resident in another country involves different tax obligations. Taxpayers with tax domicile in Spain pay taxes here on their entire worldwide income. At the same time, persons who are not Spanish tax residents pay taxes exclusively on income received in Spain.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In both cases, taxation is governed by existing double tax treaties. Such bilateral agreements help in determining and regulating tax residence, as well as in preventing double taxation of individuals who may be recognized as tax residents in several countries at once.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Spain signed <strong>more than 100 such agreements<\/strong>, which enshrines the principle of determining tax residence:<\/span><\/p>\n<ol>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">An individual is considered a resident of the country in which he has his permanent place of residence.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">If an individual has a permanent residence in both countries, he is considered a tax resident of the country with which he has closer personal and economic ties (center of vital interests).<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">If the center of vital interests cannot be established, tax residence is determined by the country where the individual usually resides.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">If an individual ordinarily resides in both countries or resides in neither country, tax residence is determined by nationality.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">In cases where an individual <a href=\"https:\/\/alegria-service.com\/blog\/immigration\/dual-citizenship-russia-spain\/\">has citizenship of both countries<\/a> or is not a citizen of either country, the final decision is made by mutual agreement of the competent authorities of both countries.<\/span><\/li>\n<\/ol>\n<h2><span style=\"font-weight: 400;\">Spanish tax residents \u2013 legal entities<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Determining the tax residence of legal entities in Spain has its own characteristics. A company is considered a Spanish tax resident if at least one of the following conditions is met:<\/span><\/p>\n<ol>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A company is considered resident if it was created under Spanish law.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A company is also considered resident if its registered office is in Spain.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Management and control of all company activities are carried out from Spain. Thus, even if a legal entity is registered in another country, but its actual management is carried out from Spain, it will be recognized as a tax resident of Spain.<\/span><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">If a company changes its tax residence, the tax period ends at the time of such change.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Spanish Tax Administration may assume that a company registered offshore is tax resident in Spain if:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The main assets of the company (directly or indirectly) consist of property or rights located in Spain.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The company&#8217;s main activities are carried out in Spain.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">This presumption can be rebutted by providing evidence that the actual management and control of the business is in another country and that the establishment and operation of the company is driven by genuine economic considerations and business purposes other than the simple management of securities or other assets.<\/span><\/p>\n<h2>FAQ on tax residence in Spain<\/h2>\n<section id=\"faq-tax-residency-es\">\n<details>\n<summary><strong>1) Who is considered a Spanish tax resident among individuals?<\/strong><\/summary>\n<p>A resident is recognized as someone who fulfills at least one criterion:<\/p>\n<ul>\n<li>stayed in Spain <strong>more than 183 days<\/strong> in a calendar year;<\/li>\n<li>has here <strong>center of economic interests<\/strong> (main source of income, asset management, business activity);<\/li>\n<li>permanently reside in Spain <strong>spouse<\/strong> and\/or <strong>minor children<\/strong> dependent &#8211; there is a presumption of residence (unless proven otherwise).<\/li>\n<\/ul>\n<\/details>\n<details>\n<summary><strong>2) How to count \u201c183 days\u201d &#8211; do short trips count?<\/strong><\/summary>\n<p>Yes.
