This alternative to official marriage is called \u201cpareja de hecho\u201d &#8211; \u201cregistered cohabitation\u201d, \u201cde facto union\u201d or \u201cde facto cohabitation\u201d.<\/p>\n<p>Civil marriage (Pareja de hecho) in Spain is in many ways similar to <a href=\"https:\/\/alegria-service.com\/blog\/marriage-in-spain-main-points\/\">official marriage in Spain<\/a>. For example, a foreign citizen who has entered into a civil marriage in Spain with a citizen of the country or with a resident has the right to request a residence permit:<\/p>\n<ul>\n<li>If the civil marriage was concluded with a Spanish citizen &#8211; a residence permit for a family member of an EU citizen;<\/li>\n<li>If a civil marriage in Spain was concluded with a citizen of another EU country who is a Spanish resident &#8211; a residence permit for family reunification with an EU citizen;<\/li>\n<li>If the civil marriage in Spain was concluded with a third-country national who is a Spanish resident and has permanent residence &#8211; <a href=\"https:\/\/alegria-service.com\/service\/family-reunification-residence-permit-spain\/\">residence permit for family reunification<\/a> under the Aliens Act.<\/li>\n<\/ul>\n<h2>How does a civil marriage in Spain differ from an official one?<\/h2>\n<p>However, there are a number of differences between official marriage (Matrimonio) and Pareja de hecho in Spain:<\/p>\n<ol>\n<li>If the official registration of marriage is regulated at the state level and provides for a uniform procedure and requirements throughout the country, then civil marriage in Spain is regulated at the level of autonomy. Currently, only 14 of the 17 Spanish autonomies register civil marriages.<\/li>\n<li>Conditions and requirements are set at the regional level. As a rule, to register a civil marriage in Spain, cohabitation for 1-2 years is required, confirmation of this fact by two witnesses, as well as registration in the autonomy where the civil marriage is planned to be registered.<\/li>\n<li>Civil marriage in Spain is registered in a special registry &#8211; Registro de Uniones de Parejas de Hecho, while official marriage is registered in the Civil Registry &#8211; Registro Civil.<\/li>\n<li>Civil marriage in Spain with a citizen of the country does not give the right to an accelerated procedure <a href=\"https:\/\/alegria-service.com\/blog\/immigration\/spanish-citizenship-all-ways\/\">obtaining Spanish citizenship<\/a>. All foreign documents must be apostilled and translated into Spanish by a sworn translator. An apostille is not affixed to certificates issued by Russian civil registry offices, in accordance with the provisions of a bilateral agreement signed in 1985 by the USSR and the Kingdom of Spain, which applies to the Russian Federation as the legal successor of the USSR.<\/p>\n<p>The application of the established form must be accompanied by:<\/p>\n<ul>\n<li>Valid identification documents of both cohabitants.<\/li>\n<li>Birth certificate for each partner.<\/li>\n<li>A certificate of registration confirming cohabitation (Certificado hist\u00f3rico de empadronamiento), or, in some regions, a statement signed by two witnesses confirming the fact of cohabitation.<\/li>\n<li>If there are children together, their birth certificates or Family Books.<\/li>\n<li>Certificate of civil status of cohabitants. Spanish citizens can consent to the verification of information in the Civil Registry; foreign citizens are required to present the appropriate document issued by the official authorities of their country.
